About these terms
These Terms of Use (Terms) apply to your use of carkingsautomotive.com (the Website) and to quotes, bookings and services provided by CarKings Automotive (“CarKings”, “we”, “us” or “our”).
By using the Website or booking our services, you agree to these Terms. If you do not agree, please do not use the Website. We may give you additional written terms for a particular job, such as on a quote or invoice. If those terms conflict with these Terms, the job-specific terms apply to that job.
Information on the Website
The content on the Website is general information about our services. We work to keep it accurate and up to date, but details such as service areas, typical response times, supported vehicle makes and example prices are indicative only and may change.
Response times shown on the Website, such as an average arrival time, are based on our typical experience and are not a guarantee. Actual arrival times depend on traffic, weather, job location and demand. We will always give you our best estimate when you call.
Quotes, pricing and payment
- Quotes. Quotes are based on the information you give us. We will confirm the price with you before any work begins.
- Changes on-site. If the job turns out to be different from what was described, for example a different key or lock type, extra parts, or a fault in the vehicle’s electronics, we will explain why and agree a revised price with you before continuing. You can decline the revised price. If you do, a call-out fee may apply as described below.
- Prices. All prices are in Australian dollars and include GST where it applies.
- Call-out and cancellation. If a call-out fee applies, we will tell you the amount when you book. If you cancel after a technician has been dispatched, or the technician cannot get access or confirm your authority when they arrive, we may charge the call-out fee we told you about.
- Payment. Unless we have agreed otherwise in writing, payment is due when the work is completed. For approved business accounts, payment is due within the terms shown on the invoice.
Your responsibilities
- Give us accurate information about the job, your location and your vehicle or property.
- Make sure our technician can safely reach the vehicle, door or lock, and tell us about any hazards, such as dogs, alarms or restricted parking.
- Remove valuables from the work area where practical.
- Tell us about any known existing damage, faults or aftermarket modifications, such as immobilisers, alarms or remote-start systems.
How we carry out the work
We always try non-destructive entry first on lockouts. In some cases, such as high-security locks, seized or faulty mechanisms, or some vehicle designs, the only practical option is to drill or replace a lock or part. If that is needed, we will explain the options and costs, and we will only go ahead with your agreement.
Key programming connects to your vehicle’s electronic systems. We use professional equipment and follow manufacturer procedures. We are not responsible for faults that existed before we started, such as a failing battery, ignition or body control module, except to the extent the Australian Consumer Law provides otherwise.
Parts and keys we supply remain our property until they are paid for in full.
Australian Consumer Law
Our goods and services come with guarantees under the Australian Consumer Law (Schedule 2 to the Competition and Consumer Act 2010 (Cth)) that cannot be excluded. These include guarantees that services will be provided with due care and skill and within a reasonable time, and that goods will be of acceptable quality and fit for purpose.
Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.
Our services come with guarantees that cannot be excluded under the Australian Consumer Law. For major failures with the service, you are entitled to cancel your service contract with us and to a refund for the unused portion, or to compensation for its reduced value. You are also entitled to be compensated for any other reasonably foreseeable loss or damage. If the failure does not amount to a major failure, you are entitled to have problems with the service rectified in a reasonable time and, if this is not done, to cancel your contract and obtain a refund for the unused portion of the contract.
If you think something is wrong with our work or a part we supplied, please contact us as soon as possible so we can make it right. For independent advice about your consumer rights in Queensland, you can contact the Office of Fair Trading at qld.gov.au/fairtrading or on 13 QGOV (13 74 68).
Limitation of liability
Nothing in these Terms excludes, restricts or modifies any right or remedy, or any guarantee, warranty or other term or condition, implied or imposed by the Australian Consumer Law or any other law that cannot lawfully be excluded or limited.
Subject to that, and to the extent permitted by law:
- where goods or services are not of a kind ordinarily acquired for personal, domestic or household use, our liability for failure to comply with a consumer guarantee is limited to, at our option, supplying the goods or services again or paying the cost of having them supplied again (or, for goods, repairing or replacing them or paying the cost of doing so);
- the Website is provided on an “as is” basis, and we do not guarantee that it will always be available, uninterrupted or free of errors or viruses; and
- we are not liable for any indirect or consequential loss arising from your use of the Website, except where that loss was reasonably foreseeable or caused by our negligence.
Intellectual property
The Website and its content, including our name, logo, text, photographs, graphics and layout, are owned by or licensed to CarKings and are protected by Australian and international intellectual property laws. You may view and print pages for your own personal, non-commercial use. You must not otherwise copy, reproduce, republish or distribute any content without our prior written permission.
Acceptable use of the Website
You must not use the Website in any way that is unlawful, or that could damage, disable or impair it. This includes submitting false or misleading information, sending spam through our forms, trying to gain unauthorised access to our systems, or introducing malicious code.
The Website may contain links to third-party websites. We do not control those websites and are not responsible for their content or practices.
Privacy
We handle personal information in accordance with our Privacy Policy, which forms part of these Terms.
Governing law
These Terms are governed by the laws of Queensland, Australia. You and we submit to the non-exclusive jurisdiction of the courts of Queensland and the courts entitled to hear appeals from them.
If any part of these Terms is found to be invalid or unenforceable, that part will be read down or severed, and the rest of the Terms will continue to apply.
Changes to these terms
We may update these Terms from time to time. The version published on this page when you use the Website or book a job is the version that applies. Changes do not affect jobs already booked.
